Potential Remediation Obligations
As of December 31, 2005, Sunoco has been named as a potentially responsible party (PRP) at 39 sites identified or potentially identifiable as Superfund sites under the federal Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). In addition, under RCRA and related state laws, Sunoco has potential remediation obligations for its current facilities, including refineries, service stations, terminals, pipelines and truck transportation facilities, as well as formerly owned sites at which contamination generated by Sunoco may be located. As of December 31, 2005, Sunoco’s accrued liability for probable and reasonably estimable remediation activities was $137 million.
Underground Storage Tank Remediation
Leaking Underground Storage Tank (UST) remediation sites are those locations where subsurface investigations have identified contaminated soil or groundwater requiring mitigation. During 2005, 107 remediation projects received regulatory closure designations and 73 new UST remediation projects were added. This resulted in a 3.6% total active site portfolio reduction in 2005. Since 2001, the total active site portfolio for Retail Marketing has been reduced by 10.7% through improved remediation efforts including utilization of new technology such as chemical oxidation, modeling, and better system design. Focus on further reducing the total site portfolio will continue and Retail Marketing initiatives, including environmental equipment capital upgrades and operational improvements, will continue to prevent contamination. New sites get identified primarily from divestment activity and other work that discover evidence of past releases. Marketing’s success in reducing their overall site portfolio has been realized despite unprecedented real estate divestment activity in the last 3 years and continually tightening regulatory requirements that make site closures more difficult to obtain.
