Enforcement Actions

Fines and penalties paid in a particular year often relate to activities in prior years. Fines and penalties paid in 2005 increased to $8, 112,749, primarily due to two penalties paid by the Marcus Hook Refinery and a third paid by Sunoco, Inc. (R&M). The first ($825,236) was for Pennsylvania Title V permit emission cap exceedances occurring in 2001 to 2004 at the Marcus Hook Refinery. A second penalty for $3,951,612 was a court ordered judgment stemming from a disagreement over Sunoco's compliance with the Reasonably Available Control Technology (RACT) regulations.

The third penalty involved the agreement Sunoco reached with the U. S. EPA concerning the February 2, 2000 pipeline spill in the John Heinz National Wildlife Refuge near Philadelphia, PA. As a part of the settlement, Sunoco has agreed to pay a $2,742,000 fine.
